Selling Your Home
If you reside in a Homeowners Association, your property is subject to the Virginia Property Owners Association Act. There are certain items you are required to provide to the purchaser upon contract on the property.
“…Person selling the lot (with or without house or building) shall disclose in the contract that (i) the lot is located within a development which is subject to the Virginia Property Owners Association Act, (ii) the Act requires the seller to obtain from the property owners association an association disclosure packet and provide it to the purchaser, (iii) the purchaser may cancel the contract within three days (72 Hours) after receiving the association disclosure packet or being notified that the packet will not be available,…” and “…(v) the right to receive the association disclosure packet and the right to cancel the contract are waived conclusively if not exercised before settlement.”

The packet contains all the recorded documents that are of record with the association, any changes made to those documents, financial information of the association; such as budgets, audits, annual dues or assessments, future capital projects to be completed, late fees, HOA contractual fee obligations (transfer fee), reserves, legal proceedings or litigation, insurance in force, covenant violations of the subject lot (if any), and any delinquencies or litigation against said lot.

Upon receipt of the disclosure packet, payment is due to Landmarc Real Estate. The only exception is for payments that will be made at time of settlement.
